The New Mediation Formula

Next month, I will be in Dallas, Texas, and have the privilege of presenting at the 2025 WIND Conference on the new mediation formula that lawyers can utilize in response to the changing nature of first-party insurance claims.


As you may know, I have been advocating for an advanced mediation formula for quite some time now to have a more meaningful mediation. That formula has various ingredients, including the right time to mediate, the power of intention, and sharing settlement authority, amongst other things.


New Mediation Formula


Our latest presentation, "The New Mediation Formula: Prepare to Succeed," builds upon our panel's presentation at 2024 WIND in Orlando, Florida. This time, we will dive into specific considerations when handling a first-party insurance claim under the new legislative changes enacted this past year in Florida.


Florida's legislative changes include removing the right to attorney's fees, shortening the time to file claims, and eliminating the assignment of benefits under policies.


The recent changes created a whole new world for first-party property claims, and both sides will need to adjust how they handle such claims going forward. Our presentation will focus on a new and improved formula for mediation to streamline and make the process as cost-effective as possible.


The Takeaway


The bottom line is that not all cases can or should be tried. Many cases are ripe for settlement, and lawyers should identify those as soon as possible and take steps to set those cases up for success at mediation. Our presentation will focus on how to do this exactly.
